A major national house building company was planning a significant residential development on eight acres of land in north Wales – a location subject to an extensive mineral reservation affecting several thousand acres. Understandably, they were concerned that this might affect the value and saleability of the houses they proposed to build.

We carried out a review of the mineral reservation to determine how it should be interpreted, and whether there was any risk that it might represent a legal or marketing risk to the properties. Our review included a desk study of the geology of the site to establish whether any of the reserved minerals occurred on or under the development site.

We were able to give our client the reassurance they needed that the geology of the site meant that the mineral reservation wouldn’t have any practical effect on the development. We were also able to advise them on the typical prices paid to buy out mineral reservations of this kind.
