One of our clients is a regional waste operator who operates a waste transfer station and recycling facility. They realised they needed expert witness support when they were charged by the Environment Agency with environmental offences relating to their handling of waste, including the contravention of Section 33 (1) (a) of the Environmental Protection Act 1990.  This stipulates that a person “shall not deposit, or knowingly cause or knowingly permit controlled waste to be deposited in or on any land unless an environmental permit authorising the deposit is in force and the deposit is in accordance with the licence”.

The case was expected to be heard at the local Magistrates court, where the penalty is up to six months imprisonment and/or a fine of up to £40,000 upon summary conviction.

Our expert witness support included providing reports to support the defence case that complied with court rules. The cases were dropped after the reports were served on the prosecution.
